  9. License Agreement

  11.  The use of bProtected« is subject to the following terms and conditions.

  14. Title To The Licensed Software
  15.  
  16.  Title to the licensed software is NOT transferred or sold to the end user.
  17.  The end user is granted a non-exclusive license to use the software
  18.  on a SINGLE computer or computer work station. EACH computer or computer
  19.  work station must have its own licensed copy of the software.

  22. Copyright Protection

  24.  bProtected« is copyrighted material. It is protected by the copyright laws
  25.  of the United States, the State of California, and other proprietary rights
  26.  of ClasysÖ Ltd. You may not make any changes or modifications to
  27.  bProtected« or this manual. You may not de compile, disassemble, or
  28.  otherwise reverse-engineer the software in any way.

  30.  You may make copies of bProtected« only under the terms of the section
  31.  entitled "Limited License To Copy The Licensed Software".
  32.  
  33.  You may use bProtected« on a thirty (30) day trial basis only, provided
  34.  you do not violate the protection afforded the licensed software by the 
  35.  copyright laws, and you agree to the terms of the license agreement. 
  36.  If you use bProtected« past the 30 day evaluation period you are
  37.  required to purchase it by paying the registration fee.

  40. Limited Warranty

  42.  ClasysÖ Ltd. does not warrant that the licensed software will meet your
  43.  requirements or that the operation of the software will be uninterrupted
  44.  or error free. The warranty does not cover any media or documentation
  45.  which has been subjected to damage or abuse by you or others.
  46.  The software warranty does not cover any copy of the licensed software
  47.  which has been altered or changed in any way. In other words, there is no
  48.  warranty either implied or expressed.
  49.  
  50.  ANY IMPLIED WARRANTIES INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR
  51.  FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED TO THE TERM OF THE EXPRESS
  52.  WARRANTIES. Some States do not allow limitations on how long an implied
  53.  warranty lasts, so the above limitation may not apply to you.

  56. Other Warranties

  58.  The warranties set forth above are in lieu of any and all other express or
  59.  implied warranties, whether oral, written, or implied, and the remedies set
  60.  forth above are the sole and exclusive remedies.

  63. Limitation Of Liability

  65.  ClasysÖ Ltd. is not responsible nor liable in anyway for any problems or
  66.  damage caused by the licensed software that may result from using the
  67.  licensed software. This includes, but is not limited to, computer hardware,
  68.  computer software, operating systems, and any computer or computing
  69.  accessories. End user agrees to hold ClasysÖ Ltd. harmless for any problems
  70.  arising from the use of the software.
  71.  ClasysÖ Ltd. SHALL NOT IN ANY CASE BE LIABLE FOR ANY SPECIAL, INCIDENTAL,
  72.  CONSEQUENTIAL, INDIRECT OR OTHER SIMILAR DAMAGES ARISING FROM ANY BREACH OF
  73.  THESE WARRANTIES EVEN IF ClasysÖ Ltd. OR ITS AGENTS OR DISTRIBUTORS HAVE BEEN
  74.  ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  75.  THIS AGREEMENT SHELL BE GOVERNED BY THE LAWS OF ISRAEL AND SHELL INURE
  76.  TO THE BENEFIT OF ClasysÖ Ltd. AND ANY SUCCESSORS, ADMINISTRATORS, HEIRS,
  77.  AND ASSIGNS. ANY ACTION OR PROCEEDING BROUGHT BY EITHER PARTY AGAINST THE
  78.  OTHER ARISING OUT OR RELATED TO THIS AGREEMENT SHALL BE BROUGHT ONLY IN
  79.  ISRAEL.

  81.  In no case shall ClasysÖ Software Ltd. liability exceed the license fees paid for
  82.  the right to use the licensed software, or a sum no greater than
  83.  one Dollar ($1.00), whichever is less.

  86. Limited License To Copy The Software
  87.  
  88.  You are granted a limited license to copy bProtected« ONLY FOR THE TRIAL
  89.  USE OF OTHERS subject to the terms of this software license agreement
  90.  described herein, and that the conditions described below are met.

  92.  -> No fee, charge or other compensation may be accepted or requested by
  93.     anyone without the express written permission of ClasysÖ Ltd. 
  94.  
  95.  -> Public Domain Disk Vendors May NOT CHARGE a fee for bProtected«
  96.     itself. However you may include bProtected« on a diskette/CD-ROM for
  97.     which you charge a nominal distribution fee. The purchaser of said
  98.     diskette must be informed in advance that the fee paid to acquire the
  99.     diskette does NOT relieve said purchaser from paying the Registration
  100.     Fee for bProtected« if said purchaser uses bProtected«.

  102.  -> The statement of shareware registration requirements MUST be printed
  103.     on a label, or other form, that is directly attached to the distribution
  104.     media.
  105.  
  106.  -> Operators of electronic bulletin board systems (SysOps) may post
  107.     bProtected« for downloading by their users without written permission
  108.     ONLY AS LONG AS THE ABOVE CONDITIONS ARE MET. A fee may be charged
  109.     for access to the BBS AS LONG AS NO SPECIFIC FEE IS CHARGED FOR
  110.     DOWNLOADING bProtected« files without first obtaining the express
  111.     written permission from ClasysÖ Ltd. to charge such a fee.

  114. Evaluation and Registration
  115.  
  116.  This is not a free software. This license allows you to use this
  117.  software for evaluation purposes without charge for a period of 30
  118.  days. If you use this software after the 30 day evaluation period
  119.  a registration fee of 29US Dollars is required.  Payment can be in
  120.  Cash, money order, checks. Payments can be in any currency.
  121.  Please try to pay in cash for small orders, if you are paying with checks
  122.  most of the money goes to the bank it self due to the bank commissions.

  136.  Quantity discounts are available, as described in the section
  137.  Ordering Information/Order Form. When payment is received you
  138.  will be sent a registration key to remove all unregistered messages and
  139.  documentation and the last version of bProtected«.

  141.  One registered copy of bProtected« may either be used by a single
  142.  person who uses the software personally on one or more computers,
  143.  
  144.  or installed on a single workstation used non simultaneously by
  145.  multiple people, but not both.

  147.  You may access the registered version of bProtected« through a network,
  148.  provided that you have obtained individual licenses for the
  149.  software covering all workstations that will access the software 
  150.  through the network.
